Updating City's Americans with Disabilities Act Transition Plan
Introduction/Background
In 1998 the City Council adopted a policy to comply with the Americans with Disabilities Act
of 1990 (ADA). The policy included a transition plan, setting forth the steps to complete
structural changes to the City's public facilities so that the City's services and programs are
readily accessible to individual with disabilities.
At that time, the City's facilities were
interpreted to only include buildings, mainly the Community Center.
Subsequently, the Barden v. City of Sacramento court case produced an opinion that essentially
includes sidewalks and curb ramps as municipal facilities that must also be made accessible.
The City Attorney's office recommended that the City conduct a self-evaluation and transition
plan update to include these facilities. Staff has completed this process and the relevant
documents are now ready for City Council review and adoption.
Discussion
Based on guidance provided by the City Attorney's office, the self evaluation and transition
plan focused on priority areas with high pedestrian activity that are critical to access to public
services, such as:
o
Government offices and major transportation facilities
o
Service centers such as hospitals, public aid agencies
o
Commercial retail centers
a Schools
These criteria led staff to focus on the Downtown Core Area and major roadways accessing
schools. The Lafayette Community Center is located on a rural road that does not have
frontage pathways or sidewalks. Non-motorized users of that facility are served by the
Lafayette Moraga Trail, which is maintained by the East Bay Regional Park District.

Areas outside of the above would only be included based on requests by individual disabilities.
Historically Lafayette has a very low rate of this type of requests, partly due to the City's
proactive and on-going effort to address any accessibility deficiencies that are known. In fact,
since ADA took effect in 1992, the City has completed around $5.1 million in improvements to
paths of travel throughout the City. This is roughly 16% of the total budget of the related
capital improvement projects.
The self evaluation did not find any high-priority deficiencies, but approximately 40 pedestrian
curb ramps may still require retrofit at some point in the future. Additionally there are less
than 20 sidewalk locations with low-level needs of repairs. Note that these needs currently do
not impede the path of travel; they merely do not strictly meet the technical details of the most
up-to-date construction standards, such as a slightly higher slope on a curb ramp or visible
cracks in the sidewalk.
The City would strive for addressing these low-level repairs in conjunction with its on-going
capital program.
As a matter of practice, the City already includes retrofit of adjacent
sidewalks and curb ramps in the scope of major street rehabilitation projects. From time to
time, the City also undertakes specific path of travel projects based on availability of grant
funding.
As part of approved plans over the next five years, staff estimates that the City will
spend approximately $600,000 to install or repair sidewalks and related path of travel facilities
to increase accessibility. This includes projects such as the Stanley Boulevard Safe Route to
School Plan, and reconstruction of Monroe Avenue access to Lafayette Elementary and Stanley
Middle Schools.
Fiscal Impact
Retrofit and repairs will be programmed in conjunction of the City's annual capital
improvement program. The City already has an approved Five-Year CIP that incorporates
significant spending on sidewalk and path of travel work in the order of $600,000.

WHEREAS, on September 14, 1998, the City Council adopted a policy of the City to
comply with the Civil Rights Act of 1964, the Equal Employment Act of 1972, the Civil
Rights Act of 1991, and the Americans with Disabilities Act of 1990 (ADA), which policy
also included a Transition Plan in accordance with the ADA's Title 28 Code of Federal
Regulations Section 35.150, setting forth the steps necessary for the City to complete
structural changes to the City's public facilities, so that the City's services, programs and
activities are readily accessible to and usable by individuals with disabilities; and
WHEREAS, Section 35.150 of the ADA also requires the City to include in its
Transition Plan a plan for providing curb ramps where pedestrian walks cross curbs,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF LAFAYETTE AS FOLLOWS:
Resolution 72-98 is hereby amended to include the new/updated policy attached
hereto as Exhibit A, as part of the City's Transition Plan which was attached as an
exhibit to Resolution 72-98. Exhibit A is entitled "City of Lafayette Self Evaluation
of Path of Travel and Curb Ramp Facilities," and is incorporated herein by reference.

A.
INTRODUCTION
This updated Self-Evaluation is a result of a field inventory completed by City Engineering staff in
and around July 2006 of all existing and missing pedestrian ramps and adjacent sidewalks located within
the public right-of-way in the downtown core area and adjacent to public schools in the City of Lafayette. It
is comprised of a Street Index listing every public street intersection in the plan and a set of maps detailing
the street system. The Street Index indicates on which map(s) a street is shown. Locations containing a
pedestrian ramp at the time of this update are noted on the maps and existing ramps are indicated by dots.
This updated Self-Evaluation is also comprised of a Pedestrian Ramp Inventory of the core area.
The inventory identifies the primary and intersecting cross street location, every corner of every
intersection, whether a ramp exists at that location, whether there are one or two ramps per corner, what
priority the corner should receive in accordance with the City's Amended Transition Plan, and descriptive
comments about site conditions which will assist the City in prioritizing locations for corrective action.
B.
THE CITY'S PAST AND FUTURE COMPLIANCE EFFORTS
The City of Lafayette recognizes the need to remove structural barriers to accessibility to its street
and path of travel facilities.
Over the years, the City has installed new pedestrian curb ramps and
upgraded or replaced older curb ramps, as well as establishing or improving path of travel circulation within
the City. The City has installed curb ramps where sidewalk exists on every street that has undergone
significant improvement or modification since the ADA took effect in 1992 and has repaired or replaced a
number of its existing curb ramps and sidewalks. The City estimates that since 1992 through 2008, it has
spent at least $5.1 million on improvements to paths of travel throughout the City. These figures do not
take into account the new curb ramps the City has required to be installed as part of private development
projects.
This effort has addressed all those priorities that would have been rated "high" in this plan.
Despite these efforts, the City estimates that there are still approximately 40 pedestrian curb
ramps to be retrofitted in high priority zones. At the time of this updated Self-Evaluation, the City estimates
the cost to retrofit these pedestrian ramps to be approximately $100,000. In addition there are sidewalk
locations with low level needs of repair or where obstructions may need to be removed to provide access.
These generally consist of facilities that are currently functional with no history of problems or complaints,
but may not meet the most recent technical standards of new construction. In conjunction with the City's
capital improvement program in the next five years, the City will spend approximately $600,000 to install
and repair sidewalks, and/or to remove obstructions to increase accessibility.
The planned improvements
respond to areas for which there is the most apparent user support and are consistent with this plan's
policy.
Given the semi-rural nature of the City, formal sidewalk outside the downtown core area is limited.
As such, the City will give priority to the high pedestrian area in accordance with its Amended Transition
Plan and the implementing regulations for the Americans with Disabilities Act (ADA) as follows:

Government offices and facilities; transportation facilities;
2)
General services centers such as hospitals, health care organizations & public aid agencies;
3)
Commercial/retail centers;
4)
Schools;
5)
Primary pedestrian pathways to facilities listed above;
6)
Any location not listed above and requested by an individual with a disability.
In assigning a priority to existing facilities, the City places emphasis on locations where there is a
history of reported complaints. Furthermore, given the fluid nature of ADA guidelines and their revisions,
facilities that are determined to be safe and usable, or otherwise do not pose an impediment to the path of
travel, are not given the highest priority even if they are not compliant with the most recent technical
standards for new construction. On an ongoing basis, the City will continue to install curb ramps and make
sidewalks accessible on all newly constructed or newly altered streets where major reconstruction projects
are performed and where there exists a curb and/or sidewalk abutting the street at that location.

and/or modify existing ramps and sidewalks when necessary to provide access based upon the following

To achieve or maintain program accessibility, the City intends to install curb ramps upon request in
areas frequented by individuals with disabilities as residents, employees or visitors, when it is reasonable
and feasible to do,
On an ongoing basis, the City will install curb ramps on all newly constructed streets and on newly
altered streets where major street pavement rehabilitation or reconstruction projects are performed and
where there exists a curb and sidewalk abutting the street at that location.

PATH OF TRAVEL AND CURB RAMP INSTALLATIONS1MODIFICATIONS
The inventory has identified no curb ramp location that ranks as a high priority according to the City's
established criteria. This is a result of recent efforts by the City to incorporate on-going repair and
replacement into street projects. The inventory identifies several high priority sidewalk locations. The
Lafayette Municipal Ordinance requires that individual property owners maintain and repair the sidewalk
fronting their respective properties. Some locations require repair by utility companies having facilities in
the public sidewalk. The City will notify and cooperate with the respective property and utility owners at the
subject locations to repair the sidewalk, It is the City's intent that the repair would be completed within a
six-month timeframe.
Locations ranked as "Low" priority have functional facilities that do not impede the path of travel, or do not
have a history of reported complaints. Many locations have significant physical and/or right-of-way barriers
to achieve exact technical compliance with current standards for new construction. These barriers require
extensive physical alteration of the road or surrounding, and/or acquisition of easements and property.
Some path of travel modifications may also result in significant impacts to abutting properties and their use,
especially in the downtown. The City maintains an on-going Five- Year Capital Improvement Program
(CIP) of street work throughout the City. To the extent practicable, the City intends to bring "Low" priority
curb ramp and path of travel locations into compliance in conjunction with scheduled CIP constructions on
these streets, because the CIP is more likely to provide adequate resources to overcome the barriers
discussed above. Furthermore, it is the City's experience that the CIP can provide an economy of scale
that allows the City's limited resources to bring more locations into compliance compared to a stand-alone
compliance effort. The City is currently investigating Community Development Block Grant and Housing
funding to augment those resources to expedite the timing of compliance.
